  • 夜市與路邊攤是台灣人生活的一部分,樂華夜市名店「肥豬的攤」已有三十五年的歷史,楊老闆因家族因素於民國104年搬遷至南機場,換點經營的第二代楊老闆因市場人潮與夜市特色差異,經營狀態從日進斗金到收支平衡。民國 109年因為covid-19影響減少國際觀光客的收入,楊老闆「肥豬的攤」的經營收入受到影響,無疑是雪上加霜。
    民國109年二月在未經同意下遭A便利商店侵權使用「肥豬的攤」商標,在預購型錄與手機APP上銷售同牌冷凍鹹酥雞調理包,因與攤位食品口味差異過大引發少數消費者負面口碑,幾經波折後順利與A便利商店化解糾紛,攜手展開合作,進軍冷凍食品市場。本教案是討論個人或企業遭遇商標權侵權糾紛時,如何選擇最有利對策並爭取最大利益。探討攤商在企業化的過程中透過商業模式重新審視核心價值,轉型企業化經營,提高成功機會。 關鍵


    Night market and street stall are part of the life of Taiwanese. The famous shop "Fat Pig Store" in Lehua Night Market has a history of 35 years. Due to the family reasons, Boss Yang moved to South Airport Night Market in year 2015, the second generation of boss Yang changed his business from daily income to balance income due to the difference of market crowd and night market characteristics. In 2020, due to the impact of COVID-19, the income of international tourists was reduced, and the operating income of Yang's "Fat Pig Store" was affected, which made the situation worse.
    In February 2020, A convenience store infringed on the trademark of "Fat Pig Store" without permission, sold the same brand of frozen salted crispy chicken conditioning packs on pre-order catalogue and mobile phone APP, resulted in damaged the reputation of “Fat Pig Store” due to the large difference in taste from the between the food from the A convenience store and the original owner (boss Yang). After several twists and turns, it is successfully resolved the dispute with A convenience store and started cooperation together. Subsequently established “Fat Pig Store” sales Co., Ltd. and entered the frozen food market. "Fat Pig Store" frozen conditioning pack was successfully listed in A convenience store in October, 2020.
    This paper is to discuss how to choose the most favorable countermeasures and strive for the maximum benefit when an individual or enterprise encounters a trademark right infringement dispute. Discuss how to re-examine the core value through the business model, transform the business operation and improve the chance of success.
