我國一直以貿易為本發展經濟基礎,本研究將透過建立數據分析模型,探討台灣面對貿易大國,美國與中國半導體產業的專利核准率現況。
專利核准率之計算包括案件在本國的核准率以及案件在他國的核准率,並透過優先權案之特徵,以同一案件做為比較基準,探討台灣半導體產業智慧財產權在美國與中國的表現狀況。
研究發現三國之中,台灣半導體產業專利在他國皆下降15-20%的核准率,而美國與中國相互核准率十分接近,台灣專利於國外能主張的權利強度較弱。台灣半導體產業雖具有權威與優勢,但於智慧財產權應需要更積極布局。
Taiwan has always been based on trade-oriented economic development. This research will discuss the current status of patent approval rates in the US and China's semiconductor industry in Taiwan facing major trading country through the data analysis model.
The calculation of the patent approval rate includes the approval rate of the case in the home country and the approval rate of the case in other countries. By the priority case, the same case is used as the benchmark to discuss the performance of the intellectual property rights of Taiwan's semiconductor industry in the United States and China.
The study found that among the three countries, the approval rate of Taiwan's semiconductor industry patents has dropped by 15-20% in other countries, while the mutual approval rate of the United States and China is very close. The strength of the rights that Taiwan's patents can assert in foreign countries is relatively weak. Although Taiwan's semiconductor industry is authoritative and has advantages,
Taiwan’s intellectual property rights should need to be more actively deployed.
