    • 本法學研究旨在以1999年第5號競爭法為基礎，透過分析 2009 年第 30 號電力法，探討印度 尼西亞電力市場改革，以進行開放電力市場的嘗試，因為競爭法保證公民在健康、有效和高 效的經濟環境中享有平等機會。此外，本研究亦在確定憲法法院關於電力市場分拆系統 最新判決的發展。這項研究的結果表明，印度尼西亞試圖通過法令允許除 國有電力公司 PT PLN (Persero) 之外的其他事業參與營運電力業務來改革電力市場。根 據競爭法，PT PLN (Persero) 不能被歸類為從事壟斷行為，因為是法規允許這樣做。電力是國家重要的生產部門，影響許多人的生計，憲法法院傾向由國家控制。本研究也參考了台灣的電力部門資料，以提供印尼做為他山之石。

    This study aims to analyze the attempt of Indonesia in reforming the electricity law in order to liberalize the electricity market, through an analysis of electricity law No. 30 of 2009 based on competition law No. 5 of 1999, as the competition law also guarantees every citizen equal opportunity in a healthy, effective, and efficient economic environment. Further, this research is also aimed to identify the development of constitutional court decisions on the unbundling system of the electricity market. This legal research is a normative research which employs statutory approach on the secondary data. The relevant secondary data is derived from library research and analyzed qualitatively. The result of this research has shown that, first, Indonesia has attempted to reform the electricity market by allowing other entities than the state-owned electricity, PT PLN (Persero), to participate in the operation of electricity businesses. Based on the competition law, PT PLN (Persero) could not be classified as engaging in monopoly, as it is permitted by applicable laws and regulations. Second, Constitutional Court Number 111/PUU-XIII/2015's clarifies the unbundling system's unconstitutionality. Electricity is a vital state production sector and affects many people's livelihoods, it must be under state control. A reference from Taiwan in this case is also presented, as the MOEA developed a two-stage plan to change the Electricity Act in order to diversify energy sources and allow for equitable consumption and choice.
