專利侵權分為字義侵權與均等侵權,具體判斷流程係在解釋完請求項後,先判斷被訴侵權對象是否落入字義範圍,若符合則應判斷被訴侵權對象構成字義侵權,若未落入而專利權人主張適用均等論時,法院會再判斷被訴侵權對象是否「適用」均等論,如果個案中不構成均等限制事由、專利權人可主張均等,接下來始進入均等侵害判斷。
均等論係為保護專利權人應有之合理利益免於不肖的技術後進者藉由微小改變侵害,故將專利權人的權利擴張到申請專利範圍的文義範圍以外,然而適用結果卻可能減損公眾對於請求項公示的信任,法院在判斷均等時如何平衡專利權人與公眾的利益是一直以來存在的議題。
本研究介紹美國最高法院、美國聯邦上訴巡迴法院的均等判斷與請求項破壞判決,並分析法院在個案中的判斷方式、從美國判例法獲得均等判斷原則與請求項破壞原則的近期判斷原則,以及提供專利侵權判斷要點之修改建議,並提供我國企業在美國進行專利訴訟時,更清楚瞭解專利權範圍的界線,進而取得專利範圍廣大的優質的專利權,以充分保護企業之研發成果。
Patent infringement is divided into literal infringement and infringement under the doctrine of equivalents (DOE). The judgment process of DOE is first to determine whether the accused infringing object falls within the scope of the literal meaning after explaining the request item. If so, it should be judged that the accused infringing object literally infringe the patent. If not, the patentee could hold that the doctrine of equivalents applies, the court will then determine whether the accused infringing object suitable for the doctrine of equivalents, and there isn’t DOE limitation causes in the case. Then starts to the doctrine of equivalents infringement judgment.
DOE aims to protect the reasonable interests of the patentee from being infringed by unscrupulous technological laggards through minor changes, so it expands the rights of the patentee beyond the scope of the patent claims, but this application results may detract public's trust from the publication of the claim scope. How may the court balance the interests of the patentee and the public when judging the DOE has always been an issue.
This study introduces the DOE judgment and claim vitiation judgment of the US Supreme Court and the US Federal Appeals Circuit, and analyzes the court's judgment rules in individual cases. This study collects the recent judgment principles of DOE judgment principle and claim vitiation principle obtained from US case law, in order to provide suggestions for revision of the key points of patent infringement judgment. This study aims to assist Taiwan enterprises with a clearer understanding of the boundaries of the scope of patent rights when they bump into patent litigation in the United States, and give advise for them to obtain high-quality patent rights with a wide range of patents to fully protect the research and development achievements of enterprises.
