  • 案例有總結司法經驗、推動法學發展的作用,傳統法學研究方法研究判例法(case law) 係由專家學者依其經驗選擇重要案例,對問題提出推論,通常需要耗費大量人力與時間。主路徑方法依據引證關係選出重要案例,取代人為判讀,與傳統法學方法相比較,有輔助傳統法學研究之功效。隨經濟發展,商標侵權行為由相類似商品擴張到不相類似的商品,使商標擁有人商標權無法受商標侵權保護,因此立法者將未經允許使用商標權人商標於與原本不相同類別的產品或服務的行為,單獨拉出以商標淡化來處理。因美國實務案例有完整引證資料庫,故以美國商標淡化實務案例為本研究主題。

    本研究擷取Westlaw 資料庫中關於商標淡化在美國最高法院、聯邦上訴法院及聯邦巡迴法院,共538個案例,然後依其引證關係,以時間為順序,繪出商標淡化案例的主要發展軌跡。而後分析此軌跡,比對與傳統法學研究結果之契合度,藉以了解主路徑方法在法學研究領域的效用。

    本研究發現,兩研究方法在商標淡化發展三階段關注的重要爭點相似。主路徑研究方法能快速繪出法學概念的重要發展歷程,比以往專家學者之人工搜尋有效率。本研究發現專家學者對研究主題遺漏的重要部分,且能看出每階段最熱門討論議題,足見主路徑研究與傳統法學研究方法有相輔相成的效果。


    This study compares two methods: the main path analysis and traditional legal research. Law cases have the functions of integrating judicial experiences and advancing the development of law. In the realm of legal research methods, experts have to sort out the issues from a collection of law cases. The task usually takes enormous human efforts. The citation-based main path analysis is a potential alternative to alleviate the efforts.

    As some famous trademarks were being used to unrelated goods, trademark dilution becomes more important nowadays. This study selects cases of Court of Appeals, Federal Circuit Court and Supreme Court (CTAF, CTA, SCT) in trademark dilution from the Westlaw database (total 538 cases). We employ the main path analysis to explore the referring relationships of these cases and trace the development of legal opinions on trademark dilution. Finally, we compare the advantages and disadvantages of the legal research method and the main path analysis method.

    The development of trademark dilution can be identified into three periods, the critical cases which we find by main path analysis is consistent with the results of the legal research methods. We conclude that the main path analysis can be a complimentary facilitator to the legal research method. Researchers who adopt the main path analysis will have the advantage of being more efficient, building a holistic framework of the specific issues, and organizing the major legal issues by time.
