隨著石油的不斷減少，國際上石油的價格一直攀升，全世界對能源的需求都在一直的增加，EIA的估計從2008年的505千兆預測2035年時全球的能源消費將會達到770千兆。而歐盟做為全球主要消費的經濟體，在本身能源供應不足以供應能源需求的情況下，發展生質能源有著重要地位。另外一方面，運輸交通中用來當作原物料的石化燃料，帶來的溫室氣體排放為歐盟主要的溫室氣體排放部門之一，而生質燃料的一方面可以取代石化燃料在運輸交通上的應用，一方面可以符合歐盟對抗氣候變遷的政策，使得溫室氣體的排放減少。因此，具有為歐盟帶來戰略地位的價值。

歐盟的生質能源法令決定生質能源政策的走向。隨著時代的改變與需求的不同，指令修定要能符合生質能源的需要，2009年可再生能源指令(2009/28/EC)不僅對生質燃料的原物料來源，規範出來一個永續性的標準，也為歐盟再生能源發展訂出目標。

本研究探討歐盟生質能源相關法令對生質能源政策的影響，還有生質能源政策的主要內容，並且對生質能源產業帶來怎樣的激勵效果。了解法令、政策與產業間的連動影響，期望能給後續歐盟生質能源政策研究和台灣生質能源政策一個重要的參考。

As oil continues to decrease, the international oil prices have been rising, worldwide demand for energy has been increasing. EIA predicts that the worldwide consumption of energy which reach 505 Btu in 2008 and expected to reach 770 Btu in 2035. European is major consumer of the world, whose energy is not sufficient enough to supply the needs with itself, the development of biomass energy takes an important role. On the other hand, fossil fuels of transportation that used as raw materials bring greenhouse gas emissions that is one of the main sector. Biofuel can not only replace fossil fuels used in transportation, but also can accord the European policy to combat climate change that makes greenhouse gas emission reduct. Therefore, Biofuel has a strategic position for the European to bring value.

Biomass law in European determines the trend of biomass policy. With the differences of time changes and needs, the revisions of directive have to meet the needs of biomass. Renewable energy directive of 2009 not only specifies the sustainable criteria in the raw materials source of biofuel, but also set out goal on renewable energy development.

In this study, it discusses the influences of the related law of biomass in European toward biomass policy, the main content of biomass policy, and biomass policy brings inspired effects. It helps to understand the linking influnces of laws, policy and industry, hoping to be the important references of the European biomass policy and law research and Taiwanese biomass policy.
