金融科技的興起改變了傳統金融業的商業模式,越來越多銀行開始透過網路及行動裝置來提升用戶的使用體驗。隨著疫情的爆發,非現金支付的使用比例大幅攀升,顯示出數位化的趨勢正逐漸被大眾所接受。對此,各國政府陸續制定相關法律規範以保障消費者權益並鼓勵創新。然而,監管不足或過度監管都會產生問題,不利於該產業的發展,因此,如何順應時代的變遷制定出最合適的監理制度一直是各國政府努力的目標。
我國將金管會指定為推動金融科技的主管機關,近年來也持續推動相關的政策及法規。本研究試圖從金融監理的角度來探討台灣電子支付的發展,希望能藉此了解台灣電子支付的發展概況與相關規範,並探討現行監理制度的成效及未來可以改善的方向。
本研究採行質性研究的個案分析法,分別針對主管機關與受監理者進行訪談,以了解各自的立場與看法。研究結果發現台灣目前的監理制度似乎對傳統的金融業者較為有利,若小型的新創業者想進入該產業多半需要與其合作。然而,傳統金融業者的態度則較為保守,大多是為了順應時代的趨勢而進行改革,這或許是源自於金融業屬於高度監理產業的特性,導致業者害怕犯錯、不願積極嘗試新事物。因此,建議主管機關可以增加與業界溝通的管道,並依市場需求適時調整相關的政策及法規。
The rise of financial technology has changed the business model of the traditional financial industry. More and more banks have begun to improve user experience through the Internet and mobile devices. With the outbreak of the pandemic, the use of non-cash payment has risen sharply, showing that the trend of digitalization is gradually being accepted by the public. In response, governments around the world have successively formulated relevant laws and regulations to protect consumer rights and encourage innovation. However, both insufficient and excessive supervision will cause problems, which are not conducive to the development of the industry. Therefore, how to adapt to the changes of the times and formulate the most suitable supervision system has always been the goal of the governments.
Taiwan has designated the Financial Supervisory Commission as the competent authority to promote financial technology and has continued to promote relevant policies and regulations in recent years. This study attempts to discuss the development of digital payments in Taiwan from the perspective of financial supervision, hoping to understand the development of digital payments in Taiwan and related regulations and to explore the effectiveness of the current supervision system and the direction for improvement in the future.
This study adopts the case analysis method and conducts interviews with the competent authorities and the company respectively to understand their respective positions and views. The results of the study found that Taiwan's current supervision system seems to be more favorable to traditional financial institutions. If new startups want to enter this industry, they may need to cooperate with them. However, the attitudes of traditional financial institutions are relatively conservative. Most of them reform merely to conform to the trend of the times. This may be traced back to the characteristics of the highly supervised industry, which leads to the fear of making mistakes and reluctance to actively try new things. Therefore, it is suggested that the competent authority can increase the communication channels with the industry, and adjust relevant policies and regulations in a timely manner based on market demands.
