隨著科技發展之進步，著作之數位化重製與散布變的十分迅速與便利，圖書館等公機構也因應此一趨勢基於保存目的盤點其館內之藏品並公開利用，惟在該機構內權利狀態為權利人不明或所在不明宛如無父無母之孤兒著作不在少數，對於該孤兒狀態之著作應如何處理與利用，是目前世界各國共同面臨的問題，當然我國也不例外，因此我國將孤兒著作授權利用的機制規定在文化創意產業發展法第二十四條中，以強制授權之方式解決孤兒著作議題。但自文創法第二十四條施行以來，僅有一例之授權案申請中，且延宕一年仍未有結果，另在數位典藏與數位學習國家型科技計畫授權平台與規範機制推動子計畫之盤點過程中，亦發現許多有孤兒權利狀態之著作無法以文創法二十四條解套。
據此，本文將以文創法二十四條為主，研析我國目前孤兒著作之授權機制以及『盡力搜尋』要件之執行可能性，並研究歐盟對於孤兒著作授權之法律規範，以及探討北歐延伸性集體管理制度與施行結果，最後再針對歐盟ARROW計畫執行『盡力搜尋』要件與建立歐洲統一資料庫系統之實務經驗做研究，給予我國文創法二十四條修法之建議，以及於我國引進延伸性集體管理機制或類似ARROW系統之評估。最後本文評估結果認為依我國集體管理組織之現況，被管理著作之種類不夠多元抑或同性質之集體管理團體過多，尚不符合實施延伸性集體授權之組織具代表性要件，因此本文認為應以立法強制授權機制為主，由文化部以下成立一單位或法人機構建立類似ARROW系統執行盡力孤兒著作權利人之要件，且由政府出面整合國內各組織資料庫資源較具有正當性，效益也比較大。

With the development of technology, works of digitization reproduction and distribution become very fast and convenience, libraries and other government institution in response to this trend and based on the preservation purposes to make inventory of the collections to public use, but within the institution of the right status is unknown for obligee or the unknown source like no parents of orphan works, and it’s not unusual. Therefore, how to deal with the orphan works has become the huge problem for most of the countries in the world. When this problem comes to our country, we have regulate the compulsory licensing as the method to deal with the orphan works. It can be found in the Law for the Development of the Cultural and Creative Industries Article 24.
However, there existed only one license case to be applied and it hasn’t judged yet since the Law for the Development of the Cultural and Creative Industries Article 24 promulgated, and founded many kind of right states couldn’t be solved by Law for the Development of the Cultural and Creative Industries Article 24.
Above all, the study will focus on the Law for the Development of the Cultural and Creative Industries Article 24, try to research the our licensing system of the orphan works, and find out the possibility to execute the diligent search condition. In addition, the study will also discuss the regulation of the licensing system in EU, and the extended collective licensing system which regulate in the north Europe. In the end, the study is trying to give some advice for building a licensing system of the orphan works in our country to solve the orphan works issue, just like the EU did (The ARROW Plan and the database system).
