正當全球開始意識到能源不足之危機，美國身為全球第一大工業國，也是全球石油消耗量最多及能源消耗第二大的國家，能源消耗約占全球的20%，其能源政策更是左右著國際能源市場的走向及各國的能源佈局。本文探討美國近十年與能源相關的法案「2005 能源政策法」、「2007能源獨立與安全法案」、「2008 食品、保育與能源法」、「2009 清潔能源與安全法草案」、「2009 美國復甦與再投資法」、「2010能源與水資源開發及相關機構預算法」為主，介紹美國如何透過增進石油消耗效率、增進潔淨再生燃料之生產等手段，推動美國能源供給之獨立與安全；在暖化問題上，不僅首度建立了「生命週期溫室氣體排放基準量」，也在後續的能源法草案中制定了溫室氣體排放限額和交易體系。歐巴馬上任後為了提升能源安全，更大幅提升潔淨能源之投資及大量降低溫室氣體排放。故我們可從美國政府的能源政策走向，觀察美國如何處理全球能源有限下面臨能源需求增長、油價攀升及氣候變遷等問題。本論文主要採文獻分析法，蒐集與相關之文獻，透過檢視進行法制面與能源政策的分析。探討美國能源法對台灣能源法制發展的啟示，就美國能源法研究提供我國在發展新能源及訂定能源法時之參考。

This essay aims to review the recent developments of American Energy Law. As the world’s largest industrialized nation, United States is as well as the maximum consumer of petroleum and the second only to China in energy consumption. U.S. confronts the shortage of petroleum, and the risk of supplying energy around the world has arisen. Additionally, economic growth is driving higher greenhouse gas emissions that cause global warming and climate change. Making a serious dent in our emissions will require a number of measures such as renewable energy targets, measures to support energy efficiency. Therefore, U.S. tends to schemed out energy strategy to achieve the energy independence and security by making energy law. American legislated「Energy Policy Act of 2005」,「The Energy Independence and Security Act of 2007」,「Food, Conservation, and Energy Act of 2008」,and「Energy and Water Development and Related Agencies Appropriations Act of 2010」in the last decade. This essay focuses on these energy laws, and observes on American energy policy. By researching these energy laws, we can find out U.S. promote energy independence and security through increasing energy efficiency, increasing the production of clean renewable fuels, promoting research on and deploy greenhouse gas capture and storage options, and smart grid. Furthermore, it also provides some suggestion on making energy policies and energy law in Taiwan.
