新創企業之智慧財產權成本效益分析-以服務導向及產品導向企業為例

論文摘要
本論文是針對新創企業的智慧財產權的成本效益進行分析。本研究採質性研究，以非結構性訪談向兩間不同性質的新創企業之決策者進行訪談，藉此為資料蒐集。隨後，本研究藉由探討新創企業決策者在創業期間對智慧財產權認知的變更、投資金額占資本額的比重以及其效益作分析，從而對新創企業的智權策略提出建議，並提供一可量化的評量標準以助新創企業的決策者調整其智慧財產權投資策略。經前述分析，本研究得出以下結論。首先，考量我國專利訴訟的低勝訴率及成本，以專利授權作為新創公司的主要獲利手段的風險是極高的。再者，由於專利授權背後的複雜性及高成本，除非拒絕專利授權會對公司即時或將來的營運造成巨大衝擊，否則，大型廠商多以迴避設計或是專利無效化等手段應對隱在的專利威脅，而不會以專利授權的方式為之。最後，本研究亦建議新創企業以專利權物在短期內的市場總利益加上風險溢酬為期待值，並以該值推算專利權物所需銷售額，以擬定專利申請策略。最後，本研究認為新創企業應及早申請、取得商標，惟以其核心業務且有確實使用之商標為限。

This Research is to analyze the cost-benefits of intellectual property rights of startup company. Interviews to the decision maker of a product oriented enterprises and a service oriented enterprises is arranged respectively for collecting data therefrom. By understanding the following details of: changes of the decision maker to the intellectual property rights, the amount of investment in the proportion of capital and the benefit generated thereby, recommendations to the intellectual strategy of the start-up companies and quantifiable assessment criteria may help decision makers of start-ups company to adjust their strategies can also be provided hereby. After the analysis, conclusions are made as follow. Firstly, considering the low winning rate of a patent litigation and high cost of patent, the risk is extremely high for a startup company to have its major portion of revenue by patent licensing. Moreover, unless the refuse of patent licensing may cause a serious impact on the large manufacturers’ immediate or future operations, otherwise, instead of accepting the licensing, means of design around or patent invalidation are mostly preferred for those large manufacturers due to the complexity and cost to start the licensing evaluation process. Finally, this study also suggests a means of IP strategy planning in accordance with the sum of total market interest may made by selling patent protected product in short term and risk premium thereof. Finally, this study suggests the start-up companies should apply for trademark early, but should only limited to the trademark that will certainly be utilized to their core business only.
