  • 我國自民國六十九年十二月十五日在新竹設立首座科學工業園區以來,政府投入數百億新台幣在園區之軟硬體建設,我國高科技產業發展到今日,政府相繼設立了新竹、中部、南部等三個主要地區的科學園區,尚在開發中的有宜蘭園區。在高科技發展項目中,今日台灣的IC產業已經擁有世界上最大的12吋晶圓廠群聚,IC設計佔全球市場僅次於美國,在晶圓代工及封裝、測試居全球龍頭寶座,另外光電產業(TFT-LCD)的平面顯示器也成為世界第一的生產國,每年為我國賺取可觀的外匯,而我國目前更致力於矽導計劃,使我國高科技產業在未來更具競爭優勢。
    另一方面,在規範建築規劃、設計、施工、構造、設備而訂定之建築技術規則乃為在維護建築物公共安全、公共交通、公共衛生及增進市容觀瞻建築法之子法,從民國三十四年二月二十六日內政部公布以來,雖然歷經多次修改,其規範內容仍以一般建築物及廠房為主,對高科技廠房這種新型態、新機能、大規模的建築物在規範上產生適宜性問題,本研究乃是以從高科技產業發展的重要性、規劃與災害特性與我國建築技術規則現況發展情形,再以實際圖例說明防火區劃、防火時效、步行距離及緊急進口為主要項目作法規適宜性的探討,並針對上述四個項目的問題提出因應構想探討,並在結論的建議事項中,以訂定高科技產業的專章法令,及建立性能法規之基礎法規、建立保險相關法令機制、及審查過程應提防災及組織應變計劃書之議題,供相關研究及政府主管機關在作修法之參考,而唯有健全、合理之法令才能使得產業的建廠過程更順利、更增加競爭力,另一方面也保障及維護人民的生命財產基本安全。

    Since the establishment of the first Hsinchu Science Park on December 15, 1980., the government of Republic of China has put into several thousand million NT dollars on the software and infrastructure of the Science Park. Up to date, besides the successfully established Science Parks in Hsinchu, Central Taiwan and South Taiwan, our government is also developing another Science Park in Yilan area. Today, in the high technology development items, Taiwan has already owned the biggest 12 inch FAB manufacturing clusters in the world. The global market share of IC design is only next to United States. Taiwan is also the number one in industry of wafer OEM, packaging and testing. More than that, Taiwan is also the number one biggest production country of the flat displays of TFT-LCD industry in the world, by which our country has generated quite a big amount of foreign income every year. The current Silicone Leading Plan will definitely increase our competitiveness in high-tech industry development in future.

    The purpose of the Building Code is to maintain the public safety, public traffic, public hygiene of buildings, and also to promote the urban landscape atmosphere. Its subsidiary code, The Building Technical Code, was established to guideline the architectural planning, design, construction, building structural and mechanical systems, and equipment. Although it has been modified several times after the announcement by the Ministry of Interior on February 26, 1945., the content still remains on the specification of the general and industrial buildings. To the issue of whether the specification suitable for new building type, new function and mega-structures like high-tech factories is still questionable.

    Based on the importance of high-tech industry development, the characteristic of planning and disaster and the status of current Building Technical Code development, also, by utilizing the major building code items like compartmentalization, fire rated definition, travel distance and emergency access, with practical illustrations and explanation, this study tries to evaluate the current Building Code suitability. In addition, the study is going to express the conceptual correspondence towards the captioned four major building items.

    In the conclusion, our study provides references to related research and governmental agency on code revision in suggested items like:
    1. establish the specific chapter for high-tech industry;
    2. set up the basic law for performance codes;
    3. set up the insurance related ordinance mechanism;
    4. propose disaster prevention and organization adaptation plan during review period.

    Only sound and reasonable ordinances can guarantee the smooth setup process and competitive ability of the high-tech industry. It also provides guarantee and protection of the basic safety on human life and property.
