我國雖非巴黎公約的締約國之一，但於2002年加入世界貿易組織（WTO）後，受該組織法律框架之一的《與貿易有關的智慧財產權協定》（TRIP）約束，進而適用了《巴黎公約》有關專利的國際優先權相關規定，我國人因而開始了豐富的外國專利申請。

本研究以我國籍申請人優先至他國布局再回我國申請專利之案件為調查對象，觀察國際申請普及化後，因我國近年的艱困國際局勢，我國人是否正逐漸採用此種特殊的申請策略進行布局。本研究因此透過專利文獻所公開的資訊，觀察當我國人產出一項開發成果欲申請專利時，是否有逐漸傾向先至他國申請專利的情形。

本研究之主要研究成果共有四者：
1. 我國人優先至他國布局再回我國申請專利之現象於各類型專利都持續呈上升趨勢。
2. 我國人近年所傾向之優先布局國家為美國，其次為中國。
3. 近年我國人傾向優先至美國布局的技術以半導體相關技術為主，且以台灣積體電路製造股份有限公司及聯發科技股份有限公司為主要的申請人。
4. 我國人傾向優先至中國布局的轉變與近年鴻海集團傾向優先至中國布局策略的轉變有很大的關連性。

Although our country is not one of the contracting states of the Paris Convention, after joining the World Trade Organization (WTO) in 2002, it became bound by the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which is part of the legal framework of the organization. As a result, our country began engaging in extensive foreign patent filings, incorporating the international priority rights provisions of the Paris Convention.

This study focuses on cases where individuals in our country prioritize filing patents in foreign countries before applying domestically, aiming to investigate whether individuals are gradually adopting this particular filing strategy due to the widespread international application trend. Given the challenging international situation our country has faced in recent years, this research aims to observe whether there is a growing tendency among individuals to file patents in foreign countries before filing domestically, using information publicly available in patent literature.

The main research findings of this study are as follows:
I. The trend of individuals in our country prioritizing foreign filings before applying domestically for patents is consistently increasing across various patent types.
II. In recent years, individuals in our country have shown a preference for prioritizing the United States as the primary jurisdiction for patent filings, followed by China.
III. Among the technologies that individuals in our country tend to prioritize filing patents in the United States, semiconductor-related technologies dominate, with Taiwan Semiconductor Manufacturing Company (TSMC) and MediaTek Inc. being the primary applicants.
IV. The shift in individuals in our country preferring to prioritize patent filings in China is closely related to the strategic shift of Hon Hai Precision Industry Co., Ltd. (Foxconn) in recent years, where they have shown a preference for prioritizing patent filings in China.
