美國專利的引用資訊當中申請人的引用或是審查人員的引用，都反映了引用和被引用專利之間的相關，但這二者所反映的相關程度是否會有不同呢？例如，一篇專利的被引用數量，普遍被認為是判斷專利重要性的依據，專利的被引用數較高，代表這篇專利可能是具有相當的影響力，但是在計量時是否該把這兩項給區分開來呢？又或是應該一視同仁？會不會審查人員所提出的引用較具價值，而申請人所提出的引用較不重要或是較不相關，所以在進行專利引用分析時應以審查人員的引用為主，而不採計申請人的引用？換句話說，審查人員的引用真的是相對於申請人引用要來的重要許多，而應該單獨作為引用分析的資料依據嗎？本研究因此選擇一美國發明專利為個案，以個案深入觀察進行微觀的分析，並針對美國專利的二種引用來源，進一步區分為三種引用情況(二種審查人員引用，一種申請人引用)，並以(1)人工判讀的方式(主觀分析)、以及(2)分類號分析的方式(客觀分析)進行相關程度的判別。本研究所獲得結論如下：基於分類號的客觀分析方面，兩種審查人員引用比起申請人引用要來的相關，但在以人工判讀的主觀分析方式上卻是申請人引用與兩種審查人員引用的相關程度無明顯差異，甚至在引用個案的對應公開案在主觀或客觀上呈現的也都是申請人引用與兩種審查人員引用的相關程度並無差異，因此就本個案而言，我們並無法肯認審查人員的引用比起申請人的引用來的重要。申請人引用似乎應該被視為和審查人員其有相同或接近的地位。在引用分析的資料選擇上，似不應將申請人引用任意剔除，申請人引用並非比起審查人員引用必然來的不相關、不重要。

The information of U.S. patent citations include applicants’ citation and examiners’ citation, and all reflect the relevance between citing patents and cited patents, but whether the degree of relevance between the two is different? For example, a patent its number of times cited is widely regarded as the basis in judging the importance of the patent. If the patent is cited more, this patent may have more influence. Then, in counting the number of citation, whether the two types of citation should be treated equally, or be given different weight? In this study, we choose a US patent as a case study, and the two kinds of US patent citation are further divided into three categories, and (1) a manual interpretation method (subjective analysis) and (2) a analysis by patent classification (objective analysis) are conducted. This study obtains the following conclusions. Based on the patent classification of objective analysis, examiners’ citations suggest more relevance than applicants’ citations, but in manual interpretation of subjective analysis, there is no strong difference in the degree of relevance between examiners’ citations and applicants’ citations. We have also conducted similar analysis on the case study’s corresponding publication, both the subjective and objective analyses show that the examiners' citations and the applicants' citations are of comparable relevance. In other words, we are unable to conclude that examiners’ citations are more relevant than applicants’ citations. The applicants’ citations probably should be considered to the same weight as examiners’ citations in patent citation analysis.
