This study investigates the influences on a company and its employees when high-tech personnel change their careers. As the technology in an industry develops, we try to maintain the order of the market by using trade secret laws to establish an environment for fair competition. The working rights of people should be guaranteed. However, the trade secrets that help to bring about competitive advantage should also be protected. How to balance the competitive advantage of a company and the rights of an employee to change careers under fair competition is the main focus of this research. When a technique in an industry falls behind or when there is a need to develop a compatible product, infringement often occurs. Clean room is a very practical practice for product development. When there is an infringement litigation, the records of executive procedures can be provided as evidence. As a result, the other party would be responsible for providing evidence. Clean room practice is widely recognized because its manageable procedures. Using clean room practice in product development helps to strengthen the intellectual property management, and results in a more solid management of a company.
