我國、美國在解讀申請專利範圍時，皆採用周邊界定主義，因此，申請專利範圍之解讀對於專利權範圍之認定相當重要。而前言為申請專利範圍之一部分，是故前言是否為限制條件將影響行使專利權之範圍。對於前言是否為限制條件一事，各國皆無共識，也沒有統一之標準。參閱美國案例法所建立之規則，法院提出之大原則為「前言是否為限制條件需看前言是否給予了請求項生命、意義及活力」，並據此發展出許多提供給社會大眾通知通用之判斷方法與規則。反觀我國，僅於專利法施行細則第19條明文規定吉普森形式之請求項需把前言視為限制條件之一環，也就是說，原則上在一般非吉普森形式之情況下，前言並非為限制條件。然而，若所有之前言皆不為限制條件，會使得用途發明不具可專利性、無法完整表達專利權範圍，或在訴訟解讀時不當的擴張權利範圍。因此，我國如何引入國外良好的判斷方法，並融合成符合我國文化之前言判斷法則即為我國重要之課題。本文將探討台、美兩國對於前言之認定標準，並對我國之實務提出淺見。

The interpretation of claim in U.S and Taiwan are using the peripheral defined doctrine. Therefore, the claims are very important for identifying the scope of the patent. Because the preamble is a part of the claim, whether the preamble is a limitation will affect the scope of patent. There are no any standard for determining whether the preamble is a limitation in the worldwide. Refer to the rules established by the U.S. case law, the court proposed the principle of “a preamble limits the invention if it recites essential structure or steps, or if it is necessary to give life, meaning, and vitality” and developed many rules based on the principle. In Taiwan, there is only a provision of Jepson type form in the Article 19 of Enforcement Rules of the Patent Act, which express that the preamble of Jepson type form considered as a limitation. That is, in general, the preamble is not a limitation except the claim is drafted to Jepson type form. However, it may cause the non-patentability of the new use patent, incomplete expression of the scope of claim or improper expansion of the scope of the claim when all of the preambles are limitations. Therefore, it is an important issue about how can we introduce to the useful foreign rules about the rule of judging and integrate the rules into our culture. This paper is exploring the rules of whether the preamble is a limitation in U.S.A and Taiwan and prospering suggestions for our practice.
