  • 3D列印使得無形與有形之間的界線變得模糊,因此專利制度必須有所因應。3D列印是一種新的生產方式,能讓一般大眾得以輕易製造與修復專利物,當3D列印機與3D掃描器普及化後,就能大大降低製造出實體物的成本,因而增加侵害專利權之可能性。本文之研究目的在於先分析3D模型檔案之可專利性,嘗試探討物品專利權人能否就侵害源頭進行保護,再針對3D列印侵害他人物品專利之侵權態樣進行分析,進一步聚焦就專利物創建以及散布CAD檔案可能產生之專利侵權行為,本文參考美國文獻以及我國專利侵權構成要件加以比較,針對我國專利制度能否因應進行檢討並給予建議。直接侵權部分,本文認為若CAD檔案與實體物之轉換係相當容易的情況下,應適度擴大製造、販賣或為販賣之要約之侵權態樣解釋,而間接侵權部分,本文認為於數位化專利侵權判斷上可以採客觀上可合理期待必有直接侵權行為人之方式,在不影響現有法制下,達到嚇阻侵權之效果。隨著3D列印技術不斷革新,專利法如何因應專利物品數位化的情形將影響專利權之保護,本文認為應重視3D列印數位化專利侵權之情形,以即早釐清專利制度於3D列印技術中所扮演之角色,進而更完善地保護3D列印使用者與專利權人之權益。


    As 3D printing blurs the line between intangible and tangible, the patent system will have to react. 3D printing is a new way of production that allows the public to easily manufacture and repair patented objects. In light of the popularization of 3D printers and 3D scanners, the cost of manufacturing objects can be greatly reduced, thereby increasing the possibility for users to infringe existing patent rights. The research purpose is to first examine the patentability of 3D model files, to analyze the types of 3D printing product patent infringement next, and to further focus on the patent infringement that may be caused by the creation or distribution of Computer-Aided Design (CAD) files of patented products. With reference to American research paper and the constituent elements of patent infringement, some suggestions are proposed. For constituting direct infringement, when the conversion between CAD files and physical objects is relatively easy, the interpretation of make, sale, or offer to sell should be appropriately expanded. In the judgment of related digital patent infringement issues, it is plausible to objectively and reasonably expect that there must be a direct infringer for users who create or distribute CAD files of patented products to constitute indirect infringement, which will have the effect of deterring infringement without affecting the existing legal system. As 3D printing technology continues to develop, how patent law reacts to the protection of patent rights in response to the digitization of patented products becomes crucial. This thesis believes that 3D printing patent infringement should be paid attention to in order to further protect the rights of patentees and the interests of 3D printing users.
