公共工程牽動著國家經濟發展及社會進步，對國計民生影響深遠，政府為促進國家建設與經濟發展，每年均編列巨額預算，俾推動國家各項重大公共建設。爰機關採購人員或民間人士均有熟悉採購法相關作業程序之必要，以免造成「錯誤採購行為」，進可共同提升採購績效，退可免不慎觸法之疑慮。
本研究主要是針對採購法實施後，機關辦理採購於招標、決標及履約等階段可能遭遇之問題，以文獻資料、實際案例及個案訪談分析等探討，可依政府採購法進而訂定相關檢核要點及獎懲規定等，以提升招標、決標及履約管理執行之成效。最後歸納相關結論如下：
一、目前國內相關採購法規函釋浩繁，令人無所適從。
二、通常虧錢生意沒廠商願做，故採購實務上可能公平與品質難兼顧。
三、採購現況常為球員兼裁判，最有利標評選結果尚欠公允。
四、採購人員的專業不足將影響採購品質與效率。
五、廠商履約過程應強制重要施工階段錄影存證，杜絕偷工減料，
六、採購招決標及履約管理應依法規，並訂定相關檢核要點及獎懲規範。

Public works affect the country's economic development and social progress, impact on the national economy profoundly. To promote national construction and economic development, the government drafts huge budget annually, in order to promote the country’s major infrastructure. Hence, it is necessary for the procurement personnel of government organizations or private individuals to be familiar with the operating procedures related to procurement law, in order to avoid "error purchasing behavior", so as to improve procurement performance, and to prevent from breaking the law inadvertently.
This study mainly focuses on the issues the government organizations might encounter during the states of purchase bidding, awarding and performance after the implementation of the procurement law, and discusses with historical data, practical examples and case interview analysis, that the government organizations may further draft related check directions and rewards and punishments regulations according to Government Procurement Law, so as to enhance the effectiveness of the bidding, awarding and performance management and execution.
The thesis has some findings as followings.
1.The current domestic procurement regulations are too miscellaneous to understand and follow.
2.Firms usually are willing to do business that has a surplus. So it may be difficult to balance fairness and quality to the procurement practices
3.Now current domestic procurement often to be the players and referees meanwhile, so it not fair for the most advantageous procurement.
4.The procurement staff that has a lack of profession will affect the quality and efficiency of the procurement.
5.It should be forced to be recorded at the important construction steps for evidence to prevent shoddy work.
6.It should be in accordance with regulation of Government Procurement at the awarding procurement and performance management, setting relevant checkpoints and norms of encouragements and punishments.
