本研究以發光鍵盤為技術主題,對美國以及中國大陸發光鍵盤進行專利地圖分析,並針對美國特定專利權人歸納出其專利家族利用連續案策略如何構築完整且不易突破的防護網。本研究先透過美國及中國大陸發光鍵盤申請趨勢、主要申請人、技術分類三個領域對發光鍵盤進行初步輪廓的瞭解。再透過分析特定專利家族申請歷程以及其規劃專利範圍歸納出其申請策略,本研究探究專利家族中每一成員案件之申請歷程以及其核准前後專利範圍的變化,將同一專利家族內的每一專利案件之專利範圍進行拆解,討論其申請策略、專利實施態樣以及專利範圍的規劃方向。
研究結果顯示專利權人Michael Shipman運用優先權以及權利終期放棄等程序策略,持續擴增專利家族成員數量。同時在同一技術特徵下透過申請不同標的,將不同元件及其特徵交錯組合,形成不同態樣的專利標的範疇。
專利申請人可透過結合程序策略以及範圍策略彈性調整符合子案申請當時產業技術發展之專利範圍,使專利獲准時之專利範圍對市面上產品具有攻擊性。本研究還透過被引證的分析佐證Michael Shipman專利家族的重要性,我國企業可依此策略做為未來申請專利時之參考。
This study discusses the technical trend of the illuminated keyboard through patent map analysis and to identify a specific patentee for sum up how patent family builds up a solid protection net. In the beginning, an overview of the patent information of the illuminated keyboard filed is provided by reviewing the patent application trend, primary applicants, and patent classification in the field of United States and China. The filling strategy of the specific patent family will be summarized based on the prosecution history and the patent claim scope. Every application of this patent family will be reviewed to check its prosecution event and the differences of the claim scope between fillings and granted.
This study shows that the patentee, Michael Shipman, expands the size of the patent family by utilizing the strategy of priority filling and the terminal disclaimer procedure. Also, the study shows that the patent family applied one invention into different subject matters, and combined the different elements to form a different type of categories.
In the strategy of patent applications, this research shows the combination of the strategies of the prosecution procedure and the scope claiming may help the applicant to adjust the patent claim based on the current technology development trend, so as to keep the granted scope as broad as possible. The study also shows the importance of the patent family of Michael Shipman by analyzing the information of the citation to confirm how this family impacts the field.
